Mykola Tomenko: The Constitutional Court of Ukraine can "step into" the History of the World Constitutionalism

 

On 17 August, Mykola Tomenko, Deputy Chairman of The Verkhovna Rada of Ukraine, met the journalists of Uzhhorod. Asked about the possible cancellation of the applicable Constitution of Ukraine, he stated that the Constitutional Court of Ukraine could "step into" the history of the world constitutionalism.

 

"Reportedly, the authorities considered three possible actions plans", he stated. "Only the first one is constitutional, as it presupposes amending of the Constitution in the Parliament. The second one is adoption of a new version or cancellation of the applicable one via referendum, and the third one is the restoration of the Constitution adopted on 28 June 1996 via the resolution of the Constitutional Court."

 

According to M.Tomenko, "neither the first nor the second actions plans were supported by the coalition factions." "Thus, the third plan was chosen. In October, Ukraine will find itself in a de facto presidential republic unless the approach of the acting authorities changes", the Deputy Chairman of The Verkhovna Rada of Ukraine stated.  

 

He stressed that this resolution was abnormal: "It goes without saying that legal, social and political nature of this decision is abnormal. It is as though admitting that the state of Ukraine and its citizens have been living illegally for almost six years." However, M.Tomenko admits that such a development of events is highly possible.

 

"I can hardly imagine the response of the world community to these actions, however, I am sure that the Constitutional Court may step into the history of the world constitutionalism for ever," the Deputy Chairman of The Verkhovna Rada of Ukraine stated.
